Welcome to the Marrakech Golfing Society (“the Society”, “we”, “us”, or “our”). By becoming a member, registering for our events, or using our website, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Membership

1.1 Eligibility
Membership is open to individuals aged 18 years or over who have an interest in golf, regardless of handicap or experience. The Society reserves the right to refuse membership to any person for reasons that are lawful and reasonable (e.g., previous misconduct at Society events).

1.2 Application and Approval
All membership applications are subject to review. Upon acceptance, you will receive a confirmation email. Membership is personal and non‑transferable.

1.3 Membership Fees
Annual membership fees are set by the Society and may be revised from time to time. Fees are payable in advance and are non‑refundable except as required by law. Failure to pay fees by the due date will result in suspension of membership benefits.

1.4 Code of Conduct
Members must behave in a respectful, sportsmanlike manner at all Society events and on partner golf courses. Discrimination, abuse, cheating, or damage to property may result in immediate expulsion without refund.

2. Tournament and Event Registration

2.1 Eligibility to Play
To participate in Society tournaments (including The Marrakech Cup, The Marrakech Tour, and the Race to the Marrakech Trophy), you must be a current financial member. Day guests may play in social events only if accompanied by a member and with prior approval.

2.2 Registration and Payment
Tournament places are limited and are allocated on a first‑come, first‑served basis. Payment of the tournament fee is required at the time of registration. The Society reserves the right to cancel a tournament if minimum participation (typically 8 players) is not met; in such case, all fees will be refunded.

2.3 Cancellation and Refunds

  • Cancellations made more than 7 days before the event: full refund or credit.
  • Cancellations between 3 and 7 days: 50% refund.
  • Cancellations less than 3 days before the event: no refund, unless a doctor’s certificate or equivalent emergency proof is provided.
  • Failure to show up without notice (“no‑show”) forfeits all fees.

2.4 Handicaps
All tournament scores must be submitted with a valid handicap (official or Society‑calculated). Members without a handicap will be assigned a temporary handicap by the Tournament Director. Deliberate misrepresentation of handicap is grounds for disqualification and disciplinary action.

3. On‑Course Rules and Safety

3.1 Golf Rules
Play shall be conducted in accordance with the Rules of Golf as approved by The R&A (and, where applicable, the Moroccan Golf Federation), supplemented by local course rules. The Tournament Director’s decision on any dispute is final.

3.2 Pace of Play
All players must maintain a reasonable pace of play (typically 4 hours 15 minutes for 18 holes). Slow play warnings may result in penalty strokes under Society rules.

3.3 Safety
Players are responsible for their own safety and the safety of others. Yelling “Fore” when a ball may endanger others is mandatory. The Society and partner courses are not liable for injuries caused by errant shots unless due to gross negligence.

3.4 Alcohol and Drugs
Alcohol consumption is permitted only after the round (e.g., at the clubhouse). Playing under the influence of alcohol or illegal drugs is strictly prohibited and will lead to immediate disqualification and possible expulsion.

4. Liability and Insurance

4.1 Assumption of Risk
Golf involves inherent risks, including being struck by balls or clubs, and injuries from uneven terrain. By participating, you assume all such risks to the fullest extent permitted by law.

4.2 No Liability for Personal Property
The Society is not responsible for lost, stolen, or damaged personal equipment (clubs, bags, personal electronics) on any course or at any Society venue.

4.3 Personal Insurance
Members and guests are strongly advised to carry their own golf liability and personal accident insurance. The Society does not provide insurance for participants.

4.4 Limitation of Liability
To the maximum extent allowed by Moroccan law, the Society, its officers, volunteers, and partner courses shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in Society activities, except where caused by willful misconduct.

5. Payments and Fees

5.1 Acceptable Payment Methods
We accept payment by credit/debit card, bank transfer, or cash (in person only). All amounts are in Moroccan Dirhams (MAD) unless otherwise stated.

5.2 Taxes
Any applicable taxes (e.g., VAT) are included in the stated fees unless otherwise notified.

5.3 Non‑Payment
If a member fails to pay any due amount, the Society may suspend their membership and event access until payment is made. Legal action may be taken to recover outstanding sums.

6. Intellectual Property

6.1 Ownership
All content on the Society’s website, including text, logos, photographs, tournament names (e.g., “The Marrakech Cup”), and trophy designs, is the property of the Marrakech Golfing Society or its licensors.

6.2 Use by Members
Members may share Society content for personal, non‑commercial purposes (e.g., on social media to promote an event). Any commercial use requires prior written consent.

6.3 Photography and Video
We may take photographs and videos during Society events for promotional use. By participating, you consent to such use unless you notify us in writing before the event. We will not use images of identifiable individuals in sensitive contexts.

7. Cancellation, Modification, and Force Majeure

7.1 Event Cancellation by the Society
If a tournament or event is cancelled by the Society due to weather (e.g., lightning, flooding), course closure, or insufficient registrations, members will receive a full refund of event fees within 14 days.

7.2 Modification of Schedule
The Society reserves the right to change dates, venues, or formats of tournaments, provided reasonable notice (at least 48 hours) is given. Members may request a refund if the change materially affects their ability to attend.

7.3 Force Majeure
The Society shall not be liable for failure to perform obligations due to causes beyond reasonable control, including natural disasters, war, civil unrest, pandemic‑related restrictions, or government orders. In such cases, fees may be credited rather than refunded, at our discretion.

8. Termination of Membership

8.1 By Member
You may resign your membership at any time by written notice. Membership fees are non‑refundable after the first 14 days of the membership year, except as required by law.

8.2 By the Society
We may terminate or suspend your membership immediately if you breach these Terms (e.g., cheating, dangerous conduct, repeated non‑payment). No refund will be given for the remaining membership period.

8.3 Effect of Termination
Upon termination, you lose all rights to participate in events and access member‑only areas of the website. Outstanding debts remain payable.

9. Governing Law and Dispute Resolution

9.1 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Morocco.

9.2 Dispute Resolution
Any dispute arising from these Terms or Society activities shall first be attempted to be resolved amicably through discussion with the Society’s committee. If unresolved, the dispute shall be submitted to the competent courts of Marrakech, Morocco.

10. Amendments

The Marrakech Golfing Society reserves the right to amend these Terms and Conditions at any time. Members will be notified by email of material changes. Continued membership or participation after notice constitutes acceptance of the amended Terms.
